KiConscious system efficacy is dependent upon each client’s engagement, receptiveness, participation, and consistency of work. Some individuals are more receptive to the system steps and find clarity more rapidly than others to this paradigm-shifting transformational process. We listen carefully to your needs and intentions, and each KiConscious session is uniquely balanced to support and amplify your own self- exploration, discovery, self-healing, and transformation. Spiritual growth and development is not a goal; rather it is a lifelong journey that requires time, energy and dedication. If you are looking for a quick fix or overnight results, this is not the system for you, and we recommend you do not commit to it.
Our KiConscious system may not be appropriate for all individuals. For this reason, we choose not to partner with individuals currently prescribed psychiatric pharmaceutical mood stabilizing or antidepressant pharmaceuticals. We will immediately refer clients to a practicing physician, psychologist, psychiatrist or mental health counselor if a significant psychological problem is discovered. We do not choose to work with clients who have been diagnosed with, or in our judgment, appear to have previously untreated serious mental or emotional problems – including that of substance abuse, major depression or personality disorders.
If a situation arises during one of our sessions, in which we find that medical or psychological intervention may be needed, Michael Nicklin and other KiConscious practitioners are ethically and legally bound to refer the client to a mental health or medical professional.
Reactions to and Risks of Expanding Conscious Awareness
When using the techniques learned in the KiConscious system on yourself or others, you must agree to take full responsibility for your own integration, application, and well-being at all times. You are required to take complete responsibility for your own physical and emotional well-being both during and after the use of our coaching sessions and materials. At no time should KiConscious be construed as a prescription, promise of benefits, claim of cure, or a guarantee of results to be achieved. You may experience or perceive negative side effects.
Any form of learning and awareness expansion brings with it the complication of conflicts as new knowledge contradicts the old. These conflicts may be mentally, emotionally, spiritually and consequently, physically stressful as the subconscious mind resists the enlightenment received from the superconscious. Transformation requires change, and the resistance to change may result in physical and emotional reactions. Any spiritual endeavor may also become a catalyst for degrees of social alienation as a growing virtual distance develops between a client and those who may feel uneasy by the changes taking place. If one successfully expands their consciousness aperture through discovery, learning, analyzing, interpreting, and reframing, one becomes more aware of previously unseen nuances in others and their everyday surroundings. One will also become more aware of nuances within their own psyche. If one successfully can expand awareness, self-identity may increasingly blur. This could be psychologically uncomfortable.
Physical and Mental Health Disclaimer
KiConscious consists of self-help consulting and coaching techniques and tools, and additionally may fall into the category of “energy therapy.” The KiConscious system (a coaching modality) does not involve the diagnosis or treatment of physical or mental disorders; is not a substitute for psychotherapy or medical practice; and does not replace or supersede any other diagnosis, therapy or treatment for other advice given to you by medical, legal, financial or other qualified professional. Always tell all your health care providers about any supplemental mental or physical health approaches you use. The information, instruction or advice given by Michael Nicklin or another KiConscious practitioner is not intended to be a substitute for that of a competent professional medical or psychological diagnosis and care.
Confidentiality and Recordings
You should understand that coaching is a broadly inclusive process that may include exploration into different areas of your life, including and not limited to health, professional or family relationships and work. Although not required, it is recommended to engage with integrity and share at times during all KiConscious sessions some confidential, personal information, at your discretion, openly and honestly. By engaging, you acknowledge that it is your decision, choice, and responsibility how to disclose and utilize information in these areas during all KiConscious sessions.
Each individual is entitled to privacy in his/her work with KiConscious. Each client’s identity and session content are strictly confidential except in a situation where such confidentiality would violate the law or otherwise cause harm. We will honor and protect your privacy and confidentiality pertaining to any communications and personal information shared with KiConscious. Your personal information will not be shared with any person or organization without your written permission.
Upon request, we are happy to sign a client-provided non-disclosure or confidentiality agreement.
Non-Disclosure and Intellectual Property
In your participation in this system work, you may be exposed to information considered proprietary and confidential. By participating in the KiConscious process, you understand that the methodology (system), coaching techniques and strategies used, information provided, as well as assignments, documents and emails are proprietary, solely for your individual personal use, and understand and agree that they may not be used for any other purposes other than your session appointments without written consent from KiConscious. All training materials are the intellectual property of KiConscious. Distribution and/or reproduction of the materials is strictly prohibited.
Terms of Engagement
Achieving the optimal results desired and expected by the client and KiConscious requires variable time duration dictated by client need. In order for the system to be most effective and to allow time for the transformation and results to occur and be integrated into the client’s life, the client should plan to commit a minimum period of three (3) months of weekly two-hour (2) KiConscious sessions, for a total first cycle of 12 sessions. A 3-month commitment ensures that you understand that it is an active process to change habits of thinking and behavior, and that you are committed to making a concentrated effort and understand that it takes time.
We recommend that following the first eight-week cycle, you take a one-month (4 week) hiatus from your weekly session schedule to “live” the system without the weekly accountability and home assignments. You may then choose to begin another eight-week cycle if the continuation is mutually agreed upon by KiConscious.
To engage properly with the KiConscious system to effectively build your foundation for transformation, we require a commitment to an initial two-hour “discovery” session, after which time you may assess whether or not to move forward with KiConscious. If you elect to move forward, you will begin with a “foundation” cycle of four sessions, paid in advance, and non-refundable regardless of circumstance should the first four-session period not be completed.
Either party may then, after the first four successive sessions, terminate the coaching relationship at any time after agreeing to have a final session before concluding the relationship. KiConscious agrees to refund any unused prepaid fees, not including the first four sessions paid in advance, per the stated terms.
If you’ve purchased a session cycle and find yourself unable to use your sessions for any reason, you may put the remaining sessions on a three-month (3) hold. Session credits will not be extended further than three months. Pre-paid session fees as part of the four- or eight-week cycle are nonrefundable should you decide to “quit” the KiConscious process.
Cancellation and Rescheduling Policy
Your session appointments are very important to us. Time held is reserved especially for you. We understand that sometimes schedule adjustments are necessary; therefore, we respectfully request at least 48-hours notice for cancellations. Please understand that when you forget or cancel your appointment without giving enough notice, we miss the opportunity to fill that appointment time, and clients on our waiting list miss the opportunity to receive sessions. We certainly understand that emergencies do arise and will accommodate those on a case-by-case basis.
The client will be required to reschedule their appointment if they are 15 minutes or more late, or the client may continue the session which will end at the standard time and not extended to accommodate the late arrival.
A “no show” appointment – defined as when a client fails to show for a scheduled appointment without cancelling or rescheduling - will count as a pre-paid session, assessed at a rate of 100% of the session fee.
Client Location Session Policy
A cancellation or postponement of a scheduled remote location client (client home, place of business, etc.) session engagement within Los Angeles County may be made with no penalty up to three (3) business days prior to the start of the scheduled session.
A cancellation or postponement of all scheduled remote location client session(s) engagement outside Los Angeles County, including domestic and international travel, may be made with no penalty up to five (5) days prior to the start of the scheduled session.
A cancellation or postponement of a scheduled remote training session not within the above stated terms will be assessed 100% of the total cost of the scheduled remote session(s).
Any unrecoverable billable travel expenses for Michael Nicklin or other KiConscious providers will be assessed to the customer regardless of when a cancellation or postponement is requested (e.g., airfare change fees).
Session and cycle fees quoted do not include airfare, accommodations, ground transportation, travel time or per diem. KiConscious invoices for travel-related expenses on a pre-determined “Expense Allowance” basis. Once KiConscious and client have agreed upon fair and reasonable estimate-based travel-related expenses, this flat amount will be charged in advance of departure for our Practitioner(s) on a cumulative per-trip basis. Actual receipts will not be provided. Any changes in expenditures are at the discretion of Michael Nicklin and KiConscious. Origin departure cities, class of travel, meal requirements, mode of ground transportation, and property/class of accommodations are determined at the sole discretion of The Nicklin Group following agreement of a pre-determined expense allowance.
AIR TRAVEL: Air travel selection is always based on non-stop or minimal-stop routing when available; unrestricted coach class fare for flight durations under 3.5 hours, and business class fare for flight durations over 3.5 hours. Acceptance of client-secured tickets is at the discretion of KiConscious.
ACCOMMODATIONS: For session times scheduled prior to 10 a.m. and/or scheduled over two successive days outside Los Angeles County, accommodations are requested for the night(s) preceding the engagement(s), including queen or king bed accommodations within close proximity to the work site is requested.
GROUND TRANSPORTATION: When necessary, an auto rental (mid-size or larger) may be requested for transportation between your site, the hotel, and the airport. If an auto is not needed or desired, taxi and/or Uber/Lyft or other ridesharing service fees will be estimated.
PER DIEM: Per diem fee includes meals and standard daily out-of-town personal expenses. The daily per diem charge for our Practitioners is pre-billed at $75 per person.
TRAVEL TIME FEE: Travel time exceeding one hour by vehicle may, at our discretion, be charged and will be calculated at $150-per-hour for total elapsed air and ground travel time, excluding session work while en-route.
Hold Harmless Agreement
You must agree to (indemnify) hold harmless Michael Nicklin, and any affiliated KiConscious Practitioner, from any claims, liability, or loss incurred directly or indirectly by you as a result of the use or application of any techniques, system, services received, or methods learned from a KiConscious Practitioner.
You must agree to (indemnify) hold harmless Michael Nicklin, and anyone affiliated with KiConscious from any claims, liability, or loss incurred directly or indirectly by you as a result of the use or application of any techniques or methods learned from a KiConscious Practitioner.
Total liability under this consulting/coaching agreement shall be limited to the total amount actually paid by a client to KiConscious. In no event shall KiConscious or a KiConscious practitioner be liable for any consequential or indirect damages alleged to result from the Practitioner's performance or obligations under this agreement.

I further declare and represent that no promise, inducement or agreement not herein expressed has been made to me to enter into this release. The release made pursuant to this paragraph shall bind my heirs, executors, personal representatives, successors, assigns, and agents.
